Notice: Temporary RVP Waiver for Colorado Gasoline Retailers

To ensure a steady fuel supply across the state, the Division of Oil and Public Safety (OPS) has issued a temporary waiver for wintertime gasoline RVP requirements, effective through April 15, 2026.

This waiver aligns Colorado’s standards with neighboring states to prevent supply disruptions caused by recent regulatory updates. The Temporary RVP waiver is effective from January through April 15th, 2026, and would require monthly compliance with the RVP requirements in D4814-24a, except that it would limit the maximum RVP to no more than the maximum allowed in that particular month in any of our neighboring states from which fuel has historically been procured.  The table below provides the precise timeline and the maximum RVP allowed to be distributed and sold at retail during this waiver period.  We strongly encourage the use of the lowest available RVP throughout the waiver period and recommend transitioning down to 12.5 psi gasoline well before April 15th,  The waiver ends with a hard stop on April 15 to ensure no impact to the summertime RVP season throughout Colorado.
